ACTION DATE:
At the Pleasure of the Board RECOMMENDATIONS: Advisory Committee: The Technical Committee for Land Application of Biosolids (TCLAB) recommends that the Land Use Committee recommend to the full Board of Supervisors, at their meeting on February 18, 2003, that Lloyd Wright; Arthur Raines; and Christopher Simmons be added to the membership of the TCLAB. Staff:
The Staff
concurs with the TCLAB in its recommendation. BACKGROUND:
On
July 25, 2002, the Board reconvened the Loudoun County Technical
Committee for Land Application of Biosolids to review the current
concerns, consider potential amendments to current code and return
the draft along with the Attorney’s Office comments to the Land
Use Committee for review and authorization to send the draft
ordinance revisions to public hearing.
Since that time, the committee has met 15 times,
including: · a public input session, ·
a session with
Zaida Thompson of the County Attorney’s Office to consider legal
issues, ·
a
session to hear from researchers, ·
a
session to hear from a producer, ·
sessions
to consider the issues, and ·
sessions
to interview additional applicants for committee membership.
Current
TCLAB members include: Bruce
Clendenin (Consultant), Chairperson; Steve Cawthron (Biosolids
Producer); Chris Hatch (farmer); and John Myers (farmer). The
nominees to the committee are:
Lloyd
Wright, Biosolids Applier; ISSUES:
-
County Attorney has concluded that the County does not have
the authority to issue a moratorium as requested by some citizens. -
More research on potential health impacts is needed according
to National Academy of Sciences, and others. -
The committee requests expanding its representation to
include additional citizen members. -
The committee is considering how the County can best
stimulate health impacts research. -
The committee, with staff and citizen assistance has been
monitoring General Assembly activities on biosolids, and has
submitted revised wording to strengthen the locality’s authority
to regulate such activities. -
Enforcement and monitoring activities are being examined to
determine if they are sufficient. -
Evaluation of technology, storage and application is being
studied to determine if processes provide the least impact to the
County. Leadership
from the TCLAB will be in attendance at the February 10, 2003, LUC
meeting to provide a status report on its work.
The core purpose of this action item is to request the Board
of Supervisors, through its Land Use Committee, to expand the
membership of the Technical Committee. FISCAL
IMPACT: None. ALTERNATIVES:
1.
Approve the draft motion to add those members suggested by
the TCLAB, DRAFT
MOTION: I move that the Land Use Committee recommend to the full Board of Supervisors, that Lloyd Wright; Arthur Raines; and Christopher Simmons be added to the membership of the TCLAB. STAFF
